Data protection
Privacy notice
This notice explains what happens to the personal information you submit through this website. It is written against the Data Protection Act 2019 and the Data Protection (General) Regulations 2021.
Who is responsible
Herman Tambo, Advocate of the High Court of Kenya, practising in Nairobi, is the data controller for information submitted here. You can reach him at herman@hermantambolaw.com.
What is collected
The enquiry form asks for four things, and nothing else:
- Your name, so a reply can be addressed to you.
- Your email address, which is the only channel used to respond.
- The area your matter falls under, chosen from a fixed list.
- A short outline of your matter, so the enquiry can be assessed before any engagement.
This website sets no cookies, runs no analytics, embeds no third-party trackers, and keeps no marketing database. Nothing you type is stored in a database on this site.
Why it is used, and on what basis
The information is used solely to read your enquiry, carry out a preliminary conflict check, and reply to you. The lawful basis is your consent in submitting the form, together with the steps taken at your request before any advocate–client engagement begins. It is not used for marketing and it is not sold or shared for any commercial purpose.
Who else sees it
The form composes an email. Delivery is handled by Resend, an email service provider acting as a processor, and the message then rests in Herman’s professional mailbox. If email delivery is unavailable, the site instead opens a draft in your own email application — in that case nothing is transmitted until you press send yourself. No one else receives your enquiry.
How long it is kept
Enquiries are kept only as long as they are needed to respond to you and, where an engagement follows, to meet the record-keeping obligations that apply to advocates. If you would like your enquiry deleted, emailherman@hermantambolaw.com and it will be removed unless a professional obligation requires it to be retained.
Your rights
Under the Data Protection Act 2019 you may:
- ask what personal data is held about you, and get a copy;
- ask for inaccurate data to be corrected;
- ask for your data to be deleted;
- object to, or ask to restrict, how it is used; and
- withdraw consent at any time, without affecting what was done before you withdrew it.
Email herman@hermantambolaw.com to exercise any of these. If you are not satisfied with the response, you may complain to the Office of the Data Protection Commissioner.
A note on privilege and sensitive material
Communications with an advocate may attract privilege under section 134 of the Evidence Act (Cap 80). Even so, please keep your first outline brief: do not send trade secrets, court exhibits, or special categories of personal data through the form. Those are better exchanged once an engagement is in place.
